Sponsor Licence Revocation
Facing a revoked or suspended sponsor licence? We act fast to protect your business and sponsored workers.
If the Home Office has revoked, or is threatening to revoke, your sponsor licence, you need to act immediately. Sponsor licence revocation is one of the most serious enforcement actions UK Visas and Immigration (UKVI) can take against a business, and it carries no automatic right of appeal. Adam Bernard Solicitors advises employers across London on responding to UKVI compliance action, challenging unlawful revocation decisions, and protecting sponsored staff — from our offices in High Holborn and Upton Park.
What Is Sponsor Licence Revocation?
Sponsor licence revocation is the permanent withdrawal of a business’s authorisation to sponsor migrant workers under the points-based immigration system. Once a licence is revoked, the organisation is removed from the register of licensed sponsors, cannot assign further Certificates of Sponsorship, and any pending applications linked to the licence are normally refused. Unlike suspension, revocation is not a warning — it is a final decision, and it is published, meaning the business appears on the publicly available revoked sponsor licence list.
Grounds for Sponsor Licence Revocation
UKVI compliance officers can revoke a sponsor licence for a wide range of breaches under the sponsor duties and compliance guidance, including:
- Failing to carry out proper right to work checks or employing an illegal worker
- Record-keeping failures, such as missing contact details, absence records or right-to-work evidence
- Failing to report significant changes — a worker leaving early, a role changing, or a change of ownership
- Assigning a Certificate of Sponsorship for a role that does not genuinely exist or does not meet the skill and salary thresholds
- Providing false or misleading information in a licence application or during a compliance visit
- Failing to cooperate with UKVI, including missed compliance visits or unanswered correspondence
- Directors or key personnel with relevant unspent criminal convictions or a history of previous licence non-compliance
A single serious breach — deliberate deception or knowingly employing an illegal worker, for example — is enough to trigger immediate revocation without a prior suspension period.
Suspension vs Revocation — What's the Difference?
UKVI does not always move straight to revocation. In many cases, a licence is suspended first, giving the sponsor a defined window (typically 20 working days) to submit written representations explaining the position and evidencing any corrective action. How that response is handled very often determines whether the licence is reinstated, downgraded, or revoked outright. This is the single most important stage to get right, and the point at which specialist advice makes the greatest difference to the outcome.
What Happens If Your Sponsor Licence Is Revoked?
The consequences of revocation extend beyond the business itself:
- Sponsored workers on a Skilled Worker or other worker visa linked to the licence typically have their permission curtailed to 60 calendar days (or less, if less time remains on their visa), during which they must find a new sponsor, switch immigration category, or leave the UK.
- Pending visa applications relying on Certificates of Sponsorship issued under the licence are normally refused.
- The business cannot sponsor any new workers and is listed on the register of revoked sponsor licences, which is checked routinely by recruiters, investors and public sector commissioning bodies.
- Future licence applications are usually barred for a cooling-off period, often 12 months, extending to 24 months for a second revocation.
Can You Challenge a Revoked Sponsor Licence?
There is no statutory right of appeal against a sponsor licence revocation decision. The only route to challenge it is an application for judicial review, on the grounds that UKVI acted irrationally, unfairly, or made a material error of fact or law. Judicial review applications are subject to strict time limits — normally within three months of the decision, though promptness is essential — so early advice is critical. In some cases, well-evidenced pre-action correspondence can persuade UKVI to reconsider before formal proceedings are needed.
