RETURNING RESIDENT 

The Returning Resident visa allows individuals who have previously held Indefinite Leave to Remain (ILR) in the UK to re-enter the country after being absent for an extended period. Those who held ILR and have been outside of the UK for more than two years may need to apply for a Returning Resident visa to maintain their right to return.
The Returning Resident visa is granted at the discretion of UK Visas and Immigration (UKVI) and decisions are based on the strength of the applicants case. Applicants have to demonstrate that they have strong ties to the UK such as family ties, length of stay in the UK or other significant as well as proof of their previous ILR status.

What Is A Returning Resident Visa?

A Returning Resident visa allows individuals who previously held ILR to re-enter the UK. This visa provides the individual with entry clearance to return to the UK. The individual will be granted entry clearance for settlement and therefore they are not required to re-apply for ILR upon entry to the UK.

Can An Individual Lose Their ILR?

You lose your indefinite leave to remain if you have been outside the UK, the Channel Islands and the Isle of Man for more than:

  • 5 continuous years, if you have settled status under the EU Settlement Scheme (unless you’re a Swiss citizen or their family member)
  • 4 continuous years, if you have settled status under the EU Settlement Scheme and you’re a Swiss citizen or their family member
  • 2 continuous years for anyone else

You may be able to re-enter the UK and reinstate your ILR by applying for a Returning Resident visa.

What Happens If ILR Has Been Lost?

If you have lost your ILR status by living overseas for more than 2 continuous years, you will no longer be able to travel freely in and out of the UK; however, you may be able to apply for a Returning Resident visa overseas to be able to re-enter the UK.

Absences Less Than 2 Years

Your ILR remains valid if you were away for less than 2 years. You can re-enter the UK as long as you had indefinite leave to remain in the UK when you last left, and you did not receive financial support from the Home Office to leave the UK

Upon arrival to the UK, you must evidence that you hold ILR; in most cases this will be an eVisa under the UK’s new digital immigration status system.

Successful Application

If your application for a Returning Resident visa is successful, you will be granted indefinite leave to enter. This is granted on a visa which is valid for 90 days. You must travel to the UK within those 90 days.

Refused Application

If your application is refused, you may be able to make a request for an Administrative Review (under Appendix AR: Administrative Review of the Immigration Rules) if you can show that there has been a caseworker error. The cost for an Administrative Review is £80.

Requirements

The eligibility requirements for a Returning Resident visa are set out under Appendix Returning Resident of the UK’s Immigration Rules. To qualify for a visa under this route you must have previously been granted ILR status which has lapsed by operation of law due to absence from the UK. You must also meet all the following requirements:

 

  • Intention to settle requirement: you must show genuine intention that your return to the UK is for the purposes of settlement
  • Previous departure from UK requirement: you must not have received assistance from public funds towards the cost of leaving the UK, unless you are applying under the Windrush Scheme
  • Strong ties to the UK requirement: you must show that you maintained strong ties to the Uk during your absence from the UK
  • Parental consent requirement for a Returning Resident aged under 18: if you are under 18 at the time of application, you must have written consent from both your parents, or one parent if that parent has sole legal responsibility, or any legal guardian.

How To Apply

To get a Returning Resident visa, you will need to apply through the UK Government’s website. The application cost £637 to apply.

To support the application, you will need to provide a number of documents, such as:

  • A current passport o other valid travel identification
  • Any previous passports
  • A passport-sized colour photograph
  • Documents to show reason(s) for your absence from the UK
  • Documents to show that your return to the UK is for the purposes of settlement
  • Documents to show that you maintained strong ties to the UK during your absence, such as family, property or business ties
  • Valid tuberculosis medical certificate depending on where you were residing
  • Any additional documents depending on your circumstances

Your dependants (partner and children) need to apply separately for a Returning Resident visa if they are eligible.

Once an application has been submitted and you have enrolled your biometric information at an overseas visa application centre, a decision should usually be made within 3 weeks. You may be able to apply under priority service depending on which country you are applying from.
