Visa on the Basis of FLR FP Partner Route

You can apply for spouse visa UK under the 10 years route if you do not meet all the requirements of the Immigration Rules for spouse visa under the 5 years route. Generally, the applicants who cannot meet the immigration status requirement, English language requirement or financial requirement do make applications for visa under the partner10 years route.

What is FLR FP Partner Application ?

The FLR FP Visa Application route means Further Leave To Remain, and accordingly F refers to Family and P refers to Private Life.

Who Is A Partner Under The Partner Route?

‘partner’ is defined as one of the following:

  • the applicant’s spouse
  • the applicant’s civil partner
  • the applicant’s fiancé, fiancée or proposed civil partner

When to choose a 5-year route as a partner and when the 10-year route should be considered.

There are two routes to settlement on the basis of family life as a partner viz 5-year route and a 10-year route. The 5-year route as a partner will be appropriate for those who meet all the suitability and eligibility requirements of the Immigration Rules at every stage. The 10-year route as a partner applies in respect of applications for leave to remain as a partner who meets all the suitability requirements, but only certain eligibility requirements.

Which form should I use?

An applicant in the UK may apply for the 5-year partner route on form FLR(M). If they fail to meet certain of the eligibility requirements, their application under the 5-year route will be refused and consideration is given to whether they qualify under the 10-year partner or private life routes. When the applicant knows that they cannot meet certain of the eligibility requirements of the 5-year partner route they can choose to apply directly for the 10-year partner or private life routes using form FLR(FP).

Can I switch anytime from a 10 Year Partner Route to a 5 Year Partner Route?

A person with leave to remain as a spouse under 10 years route can switch into spouse visa 5 years route at any time during the validity of leave to remain under the spouse visa (10 years route).

The only Requirement for switching to a 5 year partner route is meeting the financial Requirement for £29,000 and the English Language Test.

Requirements For Applying Under FLR FP

When considering applications under the Immigration Rules based on family life as a partner, your sponsor (the basis on which you are applying) is a person who is one of the following:

  • a British citizen
  • present and settled in the UK
  • a person who has been living together with you in a relationship akin to a marriage or civil partnership for at least 2 years prior to the date of application.
  • This needs to be evidenced by documents showing that the couple have been living together at the same address for at least 2 year

Requirements For Extension Of Partner Visa

For a spouse visa extension application under 10 years route to succeed, there are following main requirements:

  1. The applicant must meet the immigration status requirement which is normally met by the applicant already having leave to remain as a spouse under 10 years route;
  2. The evidence of relationship between the sponsor and the applicant including evidence of valid marriage, regular contact and cohabitation.

What Supporting Documents can I Rely on for my Partner Visa Application(FLR FP)?

  • Valid Passport of both Applicant and Sponsor
  • Valid Biometric Residence Permit ( in case of extensions)
  • Proof of cohabitation for two years prior to making the application ( this can be in the nature of Tenancy Agreements, Council Tax Bills, water Bills, Electricity and Gas Bills, NHS letters)
  • Family support letters
  • Marriage/Decree Absolute Certificate (if any)
  • Birth Certificates of children (If any)
  • Family Photos
  • Proof of Finances (if any) ( Bank Statements, Employers Letter, Payslips)

Extension Of FLR FP Visa

You can apply to extend / renew your partner visa under 10 years route from inside the UK if you are already in the UK on family visa under the 10 years route. The application for  visa renewal under the 10 years route is made using online application form FLR (FP). The applicants applying for renewal of spouse visa under 10 years route are NOT required to meet the financial requirement of earning £29,000 gross per year and the English language requirement.

You can apply anytime within 28 days before your leave to Remain expires.

What would be the Effect On my Partner Visa if I get a Divorce ?

If you are in the UK with limited leave to leave to remain in the UK for 30 months under 10 years route and your relationship with your British or settled spouse breaks down permanently (irretrievably), you or your partner can file for divorce in the UK. If the Home Office UKVI comes to know through your partner or otherwise that your relationship with your British or settled spouse has broken down irretrievably or you are already divorced in the UK, the Home Office UKVI can take steps to curtail your leave to remain in the UK by reducing your leave to remain to expire in 60 days.

You may still be able to apply for further leave to remain in one of the following circumstances:

  1. If you are a parent of a British child, you can apply for leave to remain from inside the UK as a parent of a British child;
  2. If your relationship with your British or settled spouse broke down as a result of domestic violence, you can apply for Indefinite Leave to Remain (ILR) as a victim of domestic violence. As a victim of domestic violence, you have the option to apply for non-molestation order or occupation order through family court;
  3. If you are in relationship with a different partner, you may be able to apply for leave to remain as a partner through your new partner.
  4. You can consider switching into study visa or work visa.
